End User License Agreement (EULA) for komuty.ai

This End User License Agreement ("EULA") is a legal agreement between you ("User" or "you") and komuty.ai ("we," "our," or "us") for the use of the komuty.ai software and services (collectively, the "Software"). By using the Software, you agree to be bound by the terms of this EULA. If you do not agree to these terms, do not use the Software.

1. License Grant

komuty.ai grants you a non-exclusive, non-transferable, limited license to use the Software in accordance with the terms of this EULA.

Developers are solely responsible for their applications, including but not limited to development, maintenance, and compliance with all applicable laws and regulations. komuty.ai is not responsible for any third-party applications developed for use with the Software.

4. Security and Privacy

Your security and privacy are of utmost importance to us. The Software runs locally on your computer, ensuring that your TikTok account remains entirely under your control. We do not access your account or request your login credentials. By using the Software, you acknowledge and agree that we are not liable for any security breaches, data loss, or unauthorized access to your account resulting from your use of the Software.

5. User Responsibilities

You are responsible for:

Ensuring that your use of the Software complies with all applicable laws and regulations. Maintaining the confidentiality of your account information and login credentials. Regularly backing up your data to prevent loss or damage.

6. Subscription and Payment

Access to the full functionality of komuty.ai requires a subscription plan, available at €19.99 per month. Your subscription will automatically renew unless you cancel it. By subscribing, you authorize us to charge the applicable subscription fee to your payment method on file.

7. Termination

This EULA is effective until terminated. You may terminate this EULA at any time by discontinuing use of the Software. We may terminate this EULA if you violate any of its terms. Upon termination, you must cease all use of the Software and destroy all copies of the Software in your possession.

8. Disclaimer of Warranties

The Software is provided "as is" without warranty of any kind. We disclaim all warranties, whether express, implied, or statutory, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the maximum extent permitted by law, in no event shall komuty.ai be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use the Software; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through the Software; or (iv) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the Software.

10. Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which komuty.ai is based, without regard to its conflict of law principles.

11. Changes to this EULA

We may modify this EULA at any time. We will notify you of any changes by posting the new EULA on our website. Your continued use of the Software after such changes constitutes your acceptance of the new EULA.
